The Charges:

Our client was cited for:

  • VTL 1180: Speeding 110 mph in a 55 mph zone
  • VTL 1180(a): Speed not reasonable and prudent
  • VTL 1128(a): Unsafe lane change

The stakes were high, as the accumulation of 17 points could have led to a significant increase in insurance premiums, hefty fines, and even a license suspension or revocation.

The Strategy:

In March 2024, I represented our client at a pretrial conference in Mount Pleasant Town Court. Despite our efforts to negotiate, the traffic prosecutor made it clear that no reduction would be offered. The options were stark: plead guilty or proceed to trial.

Understanding the importance of our client’s driving record and the potential impact on their future, we chose to go to trial. We were prepared to challenge the evidence and the prosecution’s case every step of the way.

The Outcome:

On the day of the trial, the police officer who issued the tickets failed to appear in court. As a result, all three tickets were dismissed. This outcome was a tremendous relief for our client, who was able to avoid the severe penalties associated with the charges.

Why This Matters:

This case is a prime example of why it’s crucial to have experienced legal representation when facing traffic violations.
