Background: Our client received a traffic ticket from a Trooper in Columbia County for violating Vehicle & Traffic Law 1144-a(a) (the move over law). With our extensive experience in handling over 1,000 traffic tickets annually, our office maintains a detailed database of officers’ patterns in ticket issuance and court appearances.

Strategy: Given our knowledge of this particular Trooper’s history of non-attendance at trials, we strategically opted to demand a trial rather than negotiate a plea bargain. A plea bargain, while often a quicker resolution, would have resulted in fines and potential additional penalties for our client.

Outcome: As anticipated, the Trooper did not appear in court upon the trial date. Consequently, the New Lebanon Justice Court dismissed the ticket due to failure to prosecute. This dismissal spared our client from any fines or penalties associated with the violation.

Conclusion: This case underscores our commitment to individualized defense strategies based on our extensive knowledge and data-driven approach. We prioritize our client’s best interests, leveraging our experience to secure favorable outcomes.
