Our firm recently secured a full dismissal of a traffic ticket in the Town of Plattsburgh Justice Court for a client charged under Vehicle and Traffic Law § 1144(a), commonly known as the “Move Over Law.”
The client was accused of failing to yield to an emergency vehicle. After the ticket was issued, we timely requested a supporting deposition, as is the client’s right under the law. The officer failed to file the supporting deposition with the court by the statutory deadline. As a result, we filed a motion to dismiss the ticket.
The court granted our motion, and the ticket was dismissed in its entirety on March 28, 2025.
